Find a specialist/broker for export from Poland (EX1)

A person is needed (logistician, customs broker, or foreign economic activity specialist) who will take on an unconventional task in Poland: to find an active customs agency that agrees to open an export declaration (EX1) for a Ukrainian individual entrepreneur.

Our situation (Input data):

1. The goods are physically located in a warehouse in Warsaw and are already fully cleared in the EU (they are in free circulation, import taxes have been paid by the previous logistics operator).

2. The commercial invoice is issued by a non-resident company (Hong Kong, without a European EORI). The buyer and the final owner of the goods is a Ukrainian individual entrepreneur.

3. The previous supplier from Hong Kong will not provide an import declaration (SAD) and will not participate in the export clearance.

4. We already have: a commercial invoice for our individual entrepreneur, MSDS, and CE certificates for all models.

What exactly needs to be done by the executor:

• Process Polish customs agencies/brokers (or use their own contacts).

• Find an agency that agrees to conduct export clearance under the indirect representation procedure (przedstawicielstwo pośrednie), where our Ukrainian individual entrepreneur will act as the Exporter.

• Negotiate the issuance of a Polish EORI number for our individual entrepreneur (if necessary) and the opening of EX1 with only the invoice, packing list, and European status of the goods (without an import declaration from the Chinese).

Possible nuances

• Many brokers are afraid to work without the initial import document (SAD) from the supplier and refuse immediately.

• It is necessary to look for higher-level agencies or brokers with experience working with non-resident warehouses who are willing to take responsibility for indirect representation.

Criteria for task completion: A successful agreement with a specific Polish customs agency that has confirmed in writing its readiness to take this case for processing under the described conditions, stated the cost, and with which the clearance can begin.
