  • Legal aspects of providing palliative care in Ukraine

    The article provides a characterization of the current legislation in the field of palliative care in Ukraine. An analysis of compliance with regulatory legal acts has been conducted. The experience of foreign countries and international standards has been considered. Attention has been paid to the problem of obtaining analgesic narcotic drugs, as well as the necessity to expand the list of drugs permitted for use. Legislative requirements for providing psychological support to patients and their relatives have been investigated, and the necessity for medical personnel to have knowledge of the psychological characteristics of palliative patients has been proven. The need for amendments to the order of the Ministry of Health of Ukraine "On certain issues of procurement, transportation, storage, dispensing, use, and destruction of narcotic drugs, psychotropic substances, and precursors in healthcare institutions" has been emphasized. To prevent violations of the rights of palliative patients, the procedure for dispensing narcotic analgesics should be simplified. Moreover, it is necessary to expand the list of medications permitted for use in Ukraine. This list should take into account modern standards and the results of progressive scientific research. In this context, it is important to study and apply the experience of developed countries.

  • CAN HEALTHCARE BE CONSIDERED A HUMAN RIGHTS CATEGORY

    The article examines healthcare from the perspective of human rights. It investigates the historical prerequisites for the emergence of this right, specifically noting that its inclusion in the Universal Declaration of Human Rights in 1948 occurred at the request of the USSR, while the USA and Western countries opposed it. Legislative acts of Ukraine are considered, which stipulate the right to healthcare and its official definition.
    On the other hand, opinions of scholars from Western countries are presented, arguing that this right is populist in nature and cannot be realized due to the limited financial resources of states. Moreover, all people have different needs for medical care, leading to the conclusion that healthy individuals must pay for the unhealthy. This is unjust, violating the very essence of the category of "right."
    Arguments are provided that, besides health, a person has many primary needs, such as food or housing. However, the state cannot meet all these needs.
    It is indicated that countries around the world have different economic capabilities, and therefore their medical standards differ. This creates inequality, as poor countries cannot afford the same treatments as wealthy ones. Conversely, under such logic, economically developed countries cannot use expensive and thus more effective medications.
    The article investigates the practice of the European Court of Human Rights and concludes that the European Court does not directly consider cases regarding violations of the right to healthcare. It is established that this right is protected within cases concerning violations of other rights, such as the right to freedom and personal inviolability, the right to life, the right to respect for private and family life, the prohibition of torture, etc.
    Conclusions are drawn that the right to healthcare is limited in nature and problematic for protection in court. The role of the state in healthcare matters lies in ensuring a legally defined minimum for the provision of medical services, protecting the environment, regulating the activities of medical institutions, and promoting a healthy lifestyle.

  • VACCINATION: VIOLATION OF RIGHTS OR OBLIGATIONS

    The article discusses the history of the emergence of anti-vaccination ideas. It has been found that this movement originated in the world as early as the 18th century after the development of the smallpox vaccine. Its appearance was driven by religious beliefs, as well as the desire of doctors to earn income from the treatments available at that time. The publication of an article by a British doctor in the scientific journal The Lancet regarding the link between the measles, mumps, and rubella vaccine and the onset of autism in children played an important role in the spread of anti-vaccination ideas. It was later established that the material was falsified and the author had a financial interest. In 2010, the publication was removed from the journal, and the doctor was banned from practicing medicine and was excluded from medical registers.
    Bioethical views have been explored regarding whether mandatory vaccinations can be considered a violation of human rights. It has been argued that in the case of refusal of vaccination, harm is inflicted on other members of society, as vaccines do not provide 100 percent protection against diseases. Moreover, to achieve herd immunity, at least 70% of the population must be vaccinated.
    Legislative acts of Ukraine, as well as international legal documents on this issue, have been examined. The decision of the European Court of Human Rights in the case of Vavichka and others against the Czech Republic dated April 8, 2021, is presented. The court issued a ruling that balanced the principles of access to education and respect for private life with the principles of health protection. In this ruling, it was stated that everyone who has no contraindications for vaccinations must be vaccinated. This fulfills the pan-European consensus on achieving herd immunity. It is also indicated that refusal of vaccination without medical contraindications is a violation of the rights of those members of society who cannot be vaccinated due to health conditions.
    The article proposes to engage in dialogue with society and explain the importance of vaccination for all. For this, scientifically validated information should be provided, and false facts in the media and social networks should be refuted. Additionally, the state’s controlling functions regarding the forgery of COVID certificates and their use should be strengthened.

  • The legal issues of surrogacy in Ukraine

    The article explores the legal principles of surrogacy in Ukraine. The positions of scientists on taking into account the interests of a child born as a result of the use of surrogacy are analyzed. It has been established that surrogacy should be contractual. The practical problems that arise during the making contracts and the use of such assisted reproductive technology as surrogacy are investigated. The solutions of the mentioned problems are suggested. The general legal principles of surrogacy and both variational and national peculiarities are distinguished. In Ukraine, surrogacy is only performed if there are medical grounds for the procedure and the possibility of use in the interests of the married man and woman.
