The offer must specify the individual entrepreneur and the tax identification number of the resource administrator (according to the offer – Entrepreneur). Currently, this information is missing in the offer.
In the "User Agreement," there is no (inactive) redirect at the bottom of the agreement to the "Agreement on the provision of paid information services." This point should be included in the website usage rules.
5. In the Offer Agreement, please clearly specify the procedure for registering and verifying Specialists by your service (granting access to the platform for Specialists).
6. The public offer must include information regarding taxation.
For example:
“1. The Entrepreneur is not a tax agent regarding the Specialist. The Entrepreneur does not perform any actions regarding the calculation, withholding from income accrued (paid, provided) to the Specialist, and regarding the transfer of taxes on behalf of and at the expense of the Specialist to the budget and any funds.
2. Specialists bear personal responsibility for compliance with tax legislation regarding income received while providing services to the User.
3. Users (Users and Specialists) during any transactions using payment cards are required, at the request of the payment service, to provide their personal data (tax identification number, etc.) in accordance with current legislation of Ukraine and regulations of the National Bank of Ukraine.”
8. The public offer must specify information regarding payment operations:
“Payment for the consultation is made through the payment service. When paying for the consultation, the issuing bank may charge a fee for the payment according to the bank's tariffs in accordance with the comprehensive banking service agreement. The issuing bank of the payment card may charge a fee (including, but not limited to):
- 0.5-1.5% + 5 UAH according to card-to-card transfer tariffs;
- 4% for payment with credit funds.”
8. The public offer must specify a clear procedure for resolving disputes that may arise between platform participants, the refund policy, and the procedure for canceling consultations.
9. Will Users have the opportunity to familiarize themselves with documents that certify the qualifications of Specialists on the platform (diplomas, certificates, etc.)? How can Users ensure that the service is provided by a doctor and not by someone pretending to be a doctor?
