Чи вживалися заходи досудового врегулювання спору спору вже після отримання повідомлення-рішення?
Ця інформація важлива, оскільки відповідно до ст.. 160 КАС позовна заява повинна містити відомості про вжиття заходів досудового врегулювання спору.
Вирішуючи Ваше питання ПК України передбачає два шляхи щодо скасування та оскарження повідомлення-рішення, перший це оскарження в адміністративному порядку, тобто податкове повідомлення-рішення про визначення суми грошового зобов'язання платника податків або будь-яке інше рішення контролюючого органу може бути скасоване контролюючим органом вищого рівня під час проведення процедури його адміністративного оскарження та в інших випадках у разі встановлення невідповідності таких рішень актам законодавства.
У разі якщо платник податків вважає, що контролюючий орган неправильно визначив суму грошового зобов’язання або прийняв будь-яке інше рішення, що суперечить законодавству або виходить за межі повноважень контролюючого органу, встановлених цим Кодексом або іншими законами України, такий платник має право звернутися із скаргою про перегляд цього рішення до контролюючого органу вищого рівня. (ст.. 55, 56 ПК України).
Другий спосіб це безпосередньо до суду, однак щоб звернутися до суду з дотриманням вимог вище вказаної статті 160 КАС України потрібно зазначити, що були вжиті заходи досудового врегулювання спору та зверталися до вищого органу із скаргою про скасування повідомлення-рішення.
Для звернення до вищого органу законодавством встановлений строк 10 днів з дня отримання Вами повідомлення-рішення. Уразі якщо строк пропущений можна клопотати про поновлення процесуального строку.
