Типового договора не существует! Договор подлежит нотариальному заверению. У каждого нотариуса своя проформа. В сделках с недвижимостью пеня не применяется!! После нотариального заверения и внесения соответствующих данных в реестр, РАЗОРВАТЬ ДОГОВОР НЕ ВОЗМОЖНО!! Только в судебном порядке оспаривать саму сделку!!

З своєї більш ніж 8+ років роботи в нотаріаті з договарами нерухомості, можу сказати що всі ризики ви не передбачите. Саме основне це перевірка по реєстрам, якщо це спадщина щоб вже була оформлена, чинність всіх правовстановлюючих документів. Це все ітак робить нотаріус при посвідченні договору. Основна порада щоб там не було, вказувати в договорі дійсну відповідність технічній документації і вказувати повну реальну суму розрахунку. Бо у випадку оскарження в суді, а договір оскаржувати можуть тільки в суді (був випадок коли дружина колишня оскаржувала надану згоду на продаж будинку)...до повернення вам буде сума вказана в договорі.

ціаквий випадок, дякую що поділилися) якщо при купівлі -продажі вона надала письмову згоду нотаріально завірену, то в неї немає шансів у суді)

Заява була засвідчена у іншого нотаріуса у іншому місті, і реально механізму відміни цих згод не має. З юридичної точки зору ні у нотаріуса, ні у продавця не було підстав відмовити в прийнятті такої заяви. Тому вона пробувала через суд скасувати договір, і суд десь пів року точно тривав.
