Budget: 1200 UAH Deadline: 1 day

Hello! I have familiarized myself with your situation. The dispute seems promising for a detailed legal and technical analysis, as there may be issues regarding the legality of the HOA's refusal to approve the metering unit, as well as the correctness of applying the Methodology for distributing thermal energy.

I have 10 years of legal practice, including experience in the field of housing and communal disputes, HOAs, contractual relations, and protecting property owners' rights. In similar cases, it is important not only to know the legislation but also to understand the technical aspects of heating supply systems and the billing mechanisms.

What I propose:
• a detailed analysis of documents and billing;
• verification of the legality of the HOA's actions;
• analysis of the prospects for installing a metering unit or changing the distribution order;
• preparation of a legal position and a step-by-step action plan;
• if necessary — preparation of official appeals, demands, or further support of the dispute.

Budget: 1500 UAH Deadline: 1 day

Hello! At the time, the homeowners' association did not allow the installation of heat meters in an apartment divided into 4 separate apartments. Legally, the apartment is divided into 4, but the utilities are not. They also did not allow the installation of a heat meter for one unit. We have been paying for heating based on bills that divided the heat losses among all who do not have a meter.

Now the payments have become unaffordable, ranging from 4500 to 5800 UAH per month for 27 sq.m. This means for 4 apartments with a total area of 100 sq.m, it can reach up to 25000 UAH.

When contacting the head of the homeowners' association, we receive the response - return the distribution of apartments back, meaning there is no way to resolve this.

I want to consult and start taking action to change the situation. The best solution is to change nothing in the networks and try to prove that the payment distribution for heating in apartments without meters should be done in a fairer way.

I need an initial analysis of detailed documents to understand what to do next.

Budget: 2000 UAH Deadline: 10 days

Hello! I am ready to take you on. I will say right away: the requirement of the head of the HOA to "return everything back" is legally untenable. If the objects have already been divided in the Register of Property Rights, they are independent units. The amounts of 4500-5800 UAH for 27 sq.m are obviously anomalous. There is either a gross violation of the relevant Methodology No. 315 of the Ministry of Regional Development in the distribution of the heat losses of the building, or abuse by the management of the HOA, which is "charging" your premises with the over-expenditures of the entire building.

Hello! Yes, the situation is generally understood, but for the initial analysis, we need to clarify a few points and review the documents.
Please let me know:
1. Is the apartment legally divided into 4 separate apartments officially? Are there extracts from the State Register of Real Property / technical passports / division decisions?
2. Does each of the 4 apartments have a separate address, personal account, and utility service contract, or are the bills handled differently?
3. Who exactly charges for heating: the homeowners' association (HOA), the heating supply organization, or the management company?
4. Is there a written refusal from the HOA regarding the installation of a heat meter? If so, please send it.
5. Have you officially contacted the HOA / heating supplier in writing regarding the installation of a meter or changes to the billing procedure?
6. What type of heating system is in the building: vertical or horizontal distribution?
7. Is there a building heat meter?
8. How many apartments in the building have individual heat meters, and how many do not?
